We are using 4.1.3 and have a similar situation.  Ours happens when 
receiving.  

We are set to answer after 1 ring.  Sometimes it rings and rings without 
picking up.  During all this ringing, if I do "cat 
/var/spool/fax/status/ttyS1" it will say, "Waiting for modem to come 
ready".  It will stay that way until the ringing stops (sending fax 
gives up).  After a few seconds it will go to "Running and idle" status. 
 The next fax that comes in will work fine.

Do you think upgrading might fix this issue as well?
