I'm not sure if you have an actual problem, or if this is a gedanken 
experiment.

We have been using faxgetty and pppd in demand mode on the same port/modem for
years, with no problem.

The short answer is that faxgetty doesn't create the lock file when it's not 
using
the port, so any outgoing communications program, e.g., pppd, can create the 
lock
file for the port, and access the modem.  After pppd creates the lock file, 
faxgetty won't touch the port, so pppd gets to use the port without 
interference.
